 Introduction

  1. This website https://daffnet.org/, to be referred to as “Daffnet”, is operated by The American Daffodil Society which is a 501(c) 3 non-profit flower society incorporated in the United States of America.
  2. The American Daffodil Society (ADS) was founded in 1954 to promote wider interest in daffodils; to encourage scientific research and education on daffodil culture, breeding, diseases, pests, exhibiting, and testing; to encourage, coordinate, and sponsor shows and exhibitions of daffodils.
  3. The mission of the ADS is to be an internationally recognized not-for-profit association of individuals, organizations, companies, and/or universities dedicated to the encouragement of widespread interest in daffodils, and to research and education with respect to their culture, breeding, preservation, diseases, pests, testing and exhibition.
  4. By accessing “Daffnet” you agree to to abide by any and all of the following Terms and Conditions governing use of the “Daffnet” forum. The ADS may change these Terms and Conditions from time to time. It is your responsibility to check the Terms and Conditions regularly.
  5. These Terms and Conditions may from time to time be supplemented by additional Terms and Conditions and these will be shown as part of the “Daffnet” registration process.
  6. You will be deemed to have accepted any amended Terms and Conditions if you continue to make use of “Daffnet” after a change to the Terms and Conditions has been made.

Acceptable Use

  1. “Daffnet” is a forum for people interested in discussing, growing, showing, or hybridizing daffodils, posts and messages are primarily about daffodils. Other discussions on “Non-Daffodil” subjects may also take place with the approval of the “Daffnet” moderators. As an international discussion forum, “Daffnet” members come from many countries and religions. Because of this multicultural nature of “Daffnet”, discussions and comments about politics or religion will not be accepted and will be deleted by our moderators.
  2. By using “Daffnet” you agree to use it for lawful purposes. “Daffnet” may not be used to harass, cause distress or inconvenience any individual person or organization. You may not use “Daffnet” to publish, post, distribute, disseminate or otherwise transmit defamatory, obscene, indecent or offensive content or to cause or promote an unlawful act.
  3. By using “Daffnet”, you agree not to attempt to obtain unauthorized access through whatever means to any part of “Daffnet”, which is restricted and to which you are not entitled to access. The content does not contain or install any viruses, worms, malware, Trojan horses or other harmful or destructive content.
  4. By using “Daffnet”, you agree not to post or re-post content originally posted to the forum or emailed to you privately by another person.
  5. By using “Daffnet”, you agree that you will not post revengeful, harmful, or destructive comments about someone else’s posts on the forum or about someone else’s behavior in context.
  6. By using “Daffnet”, you agree that your content is not spam, is not machine- or randomly-generated, and does not contain unethical or unwanted commercial content designed to drive traffic to third party sites or boost the search engine rankings of third party sites, or to further unlawful acts (such as phishing) or mislead recipients as to the source of the material (such as spoofing).
  7. By using “Daffnet”, you agree your content is not pornographic, does not contain threats or incite violence towards individuals or entities, and does not violate the privacy or publicity rights of any third party.
  8. Failure to meet acceptable use terms are grounds for termination of access to “Daffnet”.

Intellectual Property

  1. All copyright, trade marks, design rights, patents, brands, and other intellectual property rights and all content (including, but not limited to, text, graphics, photographs, applications and information) on “Daffnet” belong to the ADS or its licensors (which includes Daffnet members), or appear with the permission of others who own the intellectual property rights.
  2. Photographs contributed to Daffnet are copyrighted by the ADS and the original (member) photographer and are the joint property of the ADS and the original photographer. Photographs may not be reproduced in any form without the express approval of the ADS.
  3. You may not copy, reproduce, re-publish, adapt to create a derived work, exploit, download, post, broadcast, transmit, make available to the public, or otherwise use “Daffnet” content in any way except for your own personal, non-commercial use unless you have the written or email consent of the ADS.
  4. Use of “Daffnet” does not confer a right or license to use any copyright, design right or trademark of the ADS.
  5. Other owners and/or operators of websites may not link to “Daffnet” for commercial purposes without the written or email consent of the ADS. Links may be established for non-commercial purposes but that link must not open “Daffnet” within a frame of another website.

Administrator right to edit or delete Content

  1. ADS forum administrators occasionally have to act as editors to make content submitted by members less controversial, more meaningful, or to make grammar and typographic corrections and to improve readability and understandably.
  2. If a thread, post, or comment becomes unstable or heated and sides do not accept each other’s differences in point of view, and the discussion degenerates, the ADS forum administrators may remove the content from “Daffnet”.
  3. The ADS reserves the right to edit, delete, or add to any post, comment, or media on its web site for any reason at our sole discretion.
  4. The design of forum software, that runs “Daffnet”, allows you to edit or delete comments on a “Post” you created. The ADS believes such an edit or delete of another member’s comments would lead to problems and disagreements. Since these actions are logged, the “Daffnet” administrators will be monitoring for other-member edits and would take action if those edits are determined to be inappropriate.

Memberships

  1. The ADS reserves the right to approve or disapprove membership applications.
  2. We reserve the right to define membership rights for each individual member. This determines if a member can contribute “posts, comments, and media”, “only comments”, or “no content”.
  3. ADS forum administrators may edit user membership information, typically to show complete first and last names, and nicknames which include member country or region.

Passwords

  1. Parts of “Daffnet” may only be accessed using a password. The ADS may issue you with a password, but is under no obligation to do so and reserves the right to refuse to issue you with a password without reason. In the event that you are provided with a password, you must keep it confidential and not allow it to be used by any other party.
  2. In order to contribute to “Daffnet”, you must “Register” for membership and become a member of “Daffnet”. We require your real name and location information.
  3. When you complete the “Register” process for “Daffnet”, a password will be emailed to you.
  4. If you wish to change you password later, you can do that using the “Daffnet” “Edit My Profile” screen or panel.
  5. Passwords must be rated “Strong” when entered on the “Edit My Profile” screen or panel. If you choose a weak password, someone will access “Daffnet”, represent they are you, and post inappropriate content and messages, even spam or a virus.

Disclaimers and Limitation of Liability

  1. The ADS is not responsible for any content posted by members on the “Daffnet” forum or for the availability or content of any third party sites (i.e. those controlled by parties other than the ADS including those that may claim to be a “partner” of or “licensed by” the ADS) that are accessible through the links posted on “Daffnet”. Any links to third party websites from “Daffnet” are not endorsements of those sites by the ADS and any use of those sites by you is at your own risk.
  2. The content posted on “Daffnet” is created entirely by members of the “Daffnet” forum. The views expressed are theirs and unless specifically stated are not those of the ADS.
  3. “Daffnet” is provided on an “as is” basis and, to the fullest extent permitted by law, the ADS excludes all representations or warranties (whether express or implied by law), including implied warranties of satisfactory quality, accuracy and suitability for purpose. While the ADS uses reasonable endeavors to ensure that the content of “Daffnet” is accurate, it accepts no responsibility for errors, omissions or inaccurate content.
  4. The ADS will use reasonable effort to ensure a reliable web site, but does not warrant or guarantee “Daffnet” will be up and available 100% of the time. The content and messages posted by “Daffnet” members may not be free of spam or viruses and it is your responsibility to perform spam, virus, and other security checks to satisfy your personal computer or device requirements.

Indemnity

  1. By making use of “Daffnet” you agree to indemnify the ADS from and against all and any expenses, losses, liabilities, damages and costs incurred or suffered and any claims or legal proceedings which are brought or threatened arising from your use of or conduct on “Daffnet” and/ or a breach of the Terms and Conditions of use of “Daffnet”.

Termination of Access to “Daffnet”

  1. Although the ADS has maintained servers, web sites, and mailing lists for over sixteen years, and intends to continue these service, the ADS may terminate “Daffnet” or any other ADS web service if the ADS no longer has the ability to operate the servers or web services of the ADS can not financially support the service.
  2. The ADS may terminate the provision of “Daffnet” or restrict your access to all or any part of “Daffnet” if any event beyond its reasonable control prevents the ADS from continuing to provide “Daffnet”.
  3. The ADS retains the absolute right with or without notice to prevent you accessing “Daffnet” in part or its entirety where at the sole discretion of the ADS it is considered that you are contravening or have breached the Terms and Conditions of use of “Daffnet”.

Non-enforcement of the Rights of the ADS

  1. In the event that the ADS does not exercise or enforce any right in these Terms and Conditions, this does not waive the ADS’s right to enforce that right at a later date or on another occasion.

Validity of these Terms and Conditions

  1. If any of the Terms and Conditions for the use of “Daffnet” are determined to be unlawful, invalid or otherwise unenforceable by reason of the laws of any state or country in which these Terms and Conditions are intended to be effective, then to the extent and within the jurisdiction in which that Term and Condition is unlawful, invalid or unenforceable, it shall be deleted from these Terms and Conditions and the remaining Terms and Conditions shall continue to be binding and enforceable.

Jurisdiction

  • 1. These Terms and Conditions shall be governed by and interpreted in accordance with the laws of the United States of America which shall have exclusive jurisdiction over any disputes.
